Illinois Workers’ Compensation Attorneys & Litigators

Over 20+ Years of Illinois Injury Law & Civil Litigation Knowledge — Fighting Wrongful Employers & Their Insurance Companies

Once you’ve suffered a work-related injury or illness that keeps you from returning to work or earning the same wages, you may be entitled to workers’ compensation benefits. Spiros Law can help you file your claim and pursue benefits for lost income, medical bills, and other related expenses.

A workplace injury can change everything in an instant. One moment you’re doing your job, and the next you’re dealing with serious pain, hospital visits, and missed paychecks.

Workers’ compensation is designed to cover these costs—but getting those benefits isn’t always straightforward. If your claim is delayed, denied, or underpaid, it can leave you unsure of what to do next.

You’re not alone in this.

Roughly 1 in 5 workers will experience a serious work-related injury that keeps them out of work for an extended period. Many never expect it to happen—until it does.

Some injured workers don’t file claims because they believe they must prove their employer did something wrong. That’s not the case. Workers’ compensation is a no-fault system designed to protect employees after on-the-job injuries.

Representing locals throughout Illinois for two decades, we truly care about each person who reaches us for protection and justice after enduring a life-changing injury.

The workers’ compensation attorneys at Spiros Law understand what you’re going through and how important timely benefits are to your recovery.

    Common Causes of Workplace Accidents

Injuries, illnesses, and fatalities can happen in any job industry. A variety of scenarios can result in an accident that requires medical care. In 2019, there were 158 fatal work-related injuries in Illinois. Transportation incidents accounted for 40% of all work-related deaths, followed by violence, falls, slips, trips, and contact with equipment and objects.

The most common causes of workplace accidents include:

    • Slip/trip and fall
    • Motor vehicle accidents
    • Overexertion
    • Defective tools and equipment
    • Exposure to toxic substances
    • Fall from heights
    • Explosions and fires
    • Being struck by an object or equipment
    • Repetitive motion
    • Falling objects
    • Hazards in working areas and walkways
    • Exposed electrical wires
    • Malfunctioning machinery

Employers must provide their workers with a safe environment free from hazards that could cause injuries. If you were hurt while performing your job duties, you shouldn’t be responsible for the medical bills and other costs you incur. Your employer’s workers’ compensation insurance company should provide the benefits you need to pay for your treatment and supplement any lost income from your time off.

Common Injuries Suffered in Workplace Accidents

In 2019, there were 127,700 nonfatal workplace injuries and illnesses in Illinois. You can suffer injuries no matter what type of job you have. Whether you’re in construction or an office environment, hazards exist that can lead to accidents.

The most common occupational injuries and illnesses are:

    • Tendonitis
    • Repetitive motion injuries
    • Mesothelioma
    • Respiratory issues
    • Spinal cord damage
    • Broken bones
    • Traumatic brain injury
    • Psychological damage
    • Pulled or strained muscle
    • Burns
    • Torn tendons and ligaments
    • Electrical shock
    • Cuts and bruises
    • Cancer
    • Pneumoconiosis

Workers’ Compensation Benefits You Can Pursue in Illinois

When you apply for workers’ compensation benefits, you could recover two different types: medical benefits and disability benefits.

    Medical Benefits

Medical benefits pay for all reasonable and necessary treatment of your work-related injury or illness. This can include:

    • Emergency care
    • Surgery
    • Chiropractic treatment
    • Physical therapy
    • Doctor visits
    • Medical devices
    • Prescription medications
    • Chronic pain treatment

You should not receive any medical bills while you’re trying to recover. Your employer’s workers’ compensation insurance should pay your providers directly for all treatment you receive.

    Temporary Total Disability (TTD)

You may qualify for TTD if your doctor says you cannot return to work at all.

    • Paid at two-thirds of your average weekly wages
    • Based on earnings before the injury or illness
    • Benefits continue until you can return to work at full capacity

    Temporary Partial Disability (TPD)

You may qualify for TPD if you’re working limited or modified duties and earning less than before.

    • Paid at two-thirds of the wage difference
    • Compares your pre-injury wages to your current take-home pay
    • Applies while you’re working with restrictions

    Permanent Partial Disability Benefits (PPD)

You may qualify for PPD if your injury causes lasting limitations.

    This includes:

    • Partial or total loss of use of a body part
    • Loss of a body part
    • Partial loss of use of the body as a whole

“Loss of use” means you can’t do the same tasks you could before the injury.

    Types of PPD Benefits

    • Wage Differential
If you change jobs and earn less, you may receive two-thirds of the wage difference.
    • Scheduled Injuries
Certain body parts are assigned a set number of weeks of benefits.
      Payments are based on:
      • Your average weekly wage
      • Your doctor’s impairment rating
      • The body part affected
    • Non-Scheduled Injuries
Injuries not listed on the schedule may qualify under the “person as a whole” category, up to 500 weeks.
    • Disfigurement
Permanent and serious scarring to areas like the face, head, neck, arms, hands, chest, or legs below the knee may qualify for up to 162 weeks of benefits.

    Permanent Total Disability (PTD)

You may qualify for PTD if your injury causes a complete and permanent disability.

    This includes:

    • Total loss of use of both hands, feet, arms, legs, eyes, or a combination
    • A condition that prevents you from performing any type of work

    Benefits are paid at:

    • Two-thirds of your average weekly wage
