Workers’ Compensation Benefits You Can Pursue in Illinois
When you apply for workers’ compensation benefits, you could recover two different types: medical benefits and disability benefits.
Medical Benefits
Medical benefits pay for all reasonable and necessary treatment of your work-related injury or illness. This can include:
- Emergency care
- Surgery
- Chiropractic treatment
- Physical therapy
- Doctor visits
- Medical devices
- Prescription medications
- Chronic pain treatment
You should not receive any medical bills while you’re trying to recover. Your employer’s workers’ compensation insurance should pay your providers directly for all treatment you receive.
Temporary Total Disability (TTD)
You may qualify for TTD if your doctor says you cannot return to work at all.
- Paid at two-thirds of your average weekly wages
- Based on earnings before the injury or illness
- Benefits continue until you can return to work at full capacity
Temporary Partial Disability (TPD)
You may qualify for TPD if you’re working limited or modified duties and earning less than before.
- Paid at two-thirds of the wage difference
- Compares your pre-injury wages to your current take-home pay
- Applies while you’re working with restrictions
Permanent Partial Disability Benefits (PPD)
You may qualify for PPD if your injury causes lasting limitations.
This includes:
- Partial or total loss of use of a body part
- Loss of a body part
- Partial loss of use of the body as a whole
“Loss of use” means you can’t do the same tasks you could before the injury.
Types of PPD Benefits
- Wage Differential
If you change jobs and earn less, you may receive two-thirds of the wage difference. - Scheduled Injuries
Certain body parts are assigned a set number of weeks of benefits.
Payments are based on:- Your average weekly wage
- Your doctor’s impairment rating
- The body part affected
- Non-Scheduled Injuries
Injuries not listed on the schedule may qualify under the “person as a whole” category, up to 500 weeks. - Disfigurement
Permanent and serious scarring to areas like the face, head, neck, arms, hands, chest, or legs below the knee may qualify for up to 162 weeks of benefits.
Permanent Total Disability (PTD)
You may qualify for PTD if your injury causes a complete and permanent disability.
This includes:
- Total loss of use of both hands, feet, arms, legs, eyes, or a combination
- A condition that prevents you from performing any type of work
Benefits are paid at:
- Two-thirds of your average weekly wage
- For a period set by an Arbitrator or agreed upon with the insurer
Death Benefits
Burial Benefits
Available to the person who pays burial expenses.
- Death before Feb. 1, 2006: $4,200
- Death after Feb. 1, 2006: $8,000
Survivor Benefits
Available to eligible dependents, such as:
- A spouse
- Children under 18
Payments equal:
- Two-thirds of the deceased worker’s average weekly wages
- Paid for a period set by an Arbitrator or through negotiation
