Illinois will now allow sick days for employees attending to family members

A newly enacted state law, the Illinois Employee Sick Leave Act, which will be implemented on Jan. 1, 2017, provides a mechanism for employees to file sick leave for attending to their sick family members.

The leave must be used on the same terms under which the employee is allowed to use personal sick leave benefits. However, the new measure does not require companies to adopt sick leave policies if they don’t already have them. Specifically, the law provides for the provision of sick leave benefits for absences due to the illness, injury, or medical appointment of a family member. Employers can limit the number of sick leave benefits of this kind, but it cannot be less than the amount of personal sick leave the employee would accrue during the six months at the employee’s current accrual rate.
