Champaign couple’s lawyers accuse opposing attorney of misconduct
The attorneys who represented the Mahomet couple Kenneth and Patricia Marxmiller said MTD lawyer Marc Ansel was guilty of misconduct. Kenneth and Patricia were awarded almost $10 million in relation to a Champaign-Urbana Mass Transit District bus accident.
In motions filed during the first week of September, Ansel was accused of unnecessarily prolonging the litigation, causing unnecessary expenses, and trying to influence the jury pool. The Marxmillers’ Urbana attorneys, James Hagle and Jeffrey Frederick, said Ansel violated a gag order by talking in public about the case, and that he offered millions of dollars in settlement to the Marxmillers when the media was present in order to communicate improper and inadmissible evidence.
They also accused Ansel of pulling aside a life care planner witness and asking that person what Social Security awards are fit for Patricia – who lost her legs during the accident – when it was specifically forbidden of Ansel to discuss benefits that Patricia might receive.
