Wal-Mart and Sam’s Club Recalls Smoked Salmon in 42 States

Posted on December 31st, 2012 No Comments
Wal-Mart and Sam’s Club stores in 42 states, including Illinois, are recalling smoked salmon because of listeria concerns.
The fish product was prepared by a Miami subsidiary of Multiexport Foods in partnership with Tampa Bay Fisheries. While doing a standard lab test on a shipment of salmon that had not been distributed to store, listeria monocytogenes bacteria was found. The product is being pulled with what is described as “an overabundance of caution.”
Listeria monocytogenes bacteria cause food poisoning that can become fatal infections in the elderly, the young and those with a weakened immune system. According to WebMD.com, symptoms include muscle aches, fever and nausea or diarrhea. If the infection spreads to the nervous system, it can cause headache, stiff neck and lack of balance. Pregnant women who get the infection may miscarry or pass the infection on to their unborn child.
The recall affects the smoked salmon twin pack and 1.25 lb. product pack distributed between November 12th and December 12th. There have been no reports of sickness at this time.

Toyota Agrees to Pay $1 Billion in Economic Loss Settlement

Posted on December 28th, 2012 No Comments

Toyota has agreed to settle hundred of lawsuits in regards to unintended acceleration problems with some of its vehicles; the settlement is valued at over $1 billion. According to one lawyer, it is the largest settlement regarding automobile defects in the United States.
Many of these lawsuits began after complaints from 2009 came to the Japanese automobile maker about vehicles that accelerated on their own which caused crashes, injuries, and death. The affected lawsuits focus on the plummeting value of their vehicles after a series of recalls for the Toyota brand.
The economic loss settlement will see Toyota offering cash payments to elegible customers who sold or turned in leased vehicles between September 2009 and December 2010. This money will come from a pool of about $250 million. The settlement also includes extended warranties and retrofitting 3.2 million vehicles with new brake systems that stops the car even if the accelerator pedal is depressed.
The lawsuits were filed in the U.S. District Court of St. Ana. The lawsuits regarding injury and wrongful death are separate from this settlement. The first trial in that area begins in February 2013.
It should not take a crash or a death to fix a problem with a product. If you or a loved one know someone who has been injured by a recalled automobile, call Spiros Law at 815-929-9292 to find out your legal rights. Visit the website at www.spiroslaw.com.

Shattering Moon Roofs and Failing Breaks Force Hyundai Recall

Posted on December 24th, 2012 No Comments

Hyundai announced last week they are recalling 2012 Velostars because of two separate issues.

The South Korean car company sold 32,886 units of the hatchback in the first eleven months of this year. But there have been reports that the panoramic moon roof can shatter, especially while the vehicle is in motion. In a report filed with the National Highway Traffic Safety Administration (NHTSA), Hyundai stated that vehicles made between November 1, 2011 through April 17, 2012 may have moon roofs that may have been weakened while at the factory.

The NHTSA stated they had 11 complaints of the panoramic glass breaking, seven of those while the vehicle was in motion. Some of those seven vehicles were traveling at highway speeds.

In a separate category, recall efforts will begin next month in regards to a parking brake defect. While it only affects manual transmissions, it was discovered that road grime and moisture may cause parking brake components to bind and cause a failure in the system.

Iginition and Roll-away Problems Leads to Honda Recall

Posted on December 13th, 2012 No Comments

Honda announced plans to recall over 800,000 vehicles because of problems with the ignition system that can allow the vehicles to keep rolling when turned off.

U. S. safety inspectors opened a probe in October 2012 after receiving 43 consumer complaints regarding the 2003-2004 Honda Odyssey and Pilot models in relations to the ignition switch. The Japanese auto company reports that a part in the ignition system could become worn or damaged and allows a key to be removed from the ignition without the vehicle transmission lever being in park. In doing so, this can allow the vehicle to roll away and perhaps cause a crash.

The National Highway Traffic Safety Administration (NHTSA) reported that it received complaints purporting that some Honda vehicles had rolled after ignition failure. These vehicles stopped only after hitting objects including but not limited to parked cars, fences, and a tree. One consumer stated they had been knocked down and run over by a 2003 Odyssey while attempting to stop it from rolling away, fracturing a fibula (calf bone) in the process.

Honda stated that the recall will affect the Odyssey minivans and Pilot crossovers from model years 2003 to 2004, and the Acura MDX crossover from model years 2003 to 2006. Recall notices will be sent out to owners, according to American Honda, starting in February 2013.

Bedford Park Go-Cart Facilty Sued for Faulty Equipment

Posted on December 10th, 2012 No Comments

A woman has filed suit against a Bedford Park go-kart facility for negligence.

Kimberly Ball visited the Chicago Race Factory in early May of this year. The lawsuit states that when employees seated her in a go-cart with a broken seat belt, they allegedly stated adults did not need the safety harnessed and those were meant for children.

But as Ball was driving her go-cart in the first turn her body slid on the driver’s seat which caused her leg, knee, hip and ankle to be injured according to the suit. The lawsuit claims negligence on the part of the company and employees for allowing Bell to ride in a go-cart with a broken seat belt. It also names the manager in the suit, alleging he did not properly train staff and allowed them to assign the woman to a go-kart with broken equipment. Bell is asking for an excess of $50,000.

Indian drugmaker Ranbaxy Laboratories Ltd., discovered the problem with certain lots of 10-, 20- and 40-milligram doses of the drug, known generically as atorvastatin calcium. The 80-milligram dosage does not appear to be affected. The drug is a generic version of Lipitor which is used to control cholesterol.

Ranbaxy did not state how the problem was discovered nor did it report any injuries connected to the tainted medication. The company is currently conducting an investigation which it expects to take two weeks to complete.

Defective Airbag Deployments Leads to Recall for Jeep SUVs

Posted on November 12th, 2012 No Comments

Chrysler announced that they are recalling Jeep Grand Cherokee and Jeep Liberty vehicles dues to problems with the air bag release.

Over 900,000 vehicles produced between 2002 and 2004 are being recalled because of airbags that are deploying without cause. The National Highway Traffic Safety Administration (NHTSA) began a preliminary investigation due to complaints of inadvertent deployments.

The study found that there were 215 cases of unintentional airbag deployment that resulted in 81 minor injuries involving both Jeep SUV models. The cause comes from a module that fails to keep the front and/or side airbag  from deploying when the vehicle is not in the middle of an impact action.

Of the recalled vehicle, over 740,000 come from the United States and over 49,000 come from Canada. The remaining recalled vehicles come from outside those two countries.

Aerosol Sunscreen Products Recalled by Manufacturers Of Banana Boat Sunscreen

Posted on October 26th, 2012 No Comments

A variety of Banana Boat Aerosol Sunscreen products are being recalled by Energizer Holdings because of reports of fire danger when using these products.

On October 19th, the company announced the recall that includes products such as UltraMist  Sport, UltraMist Ultra Defense and UltraMist Kids. This is happening because of five separate reports of consumers suffering burns after using the product.  Four of these reports came from the United States and the fifth came from Canada.

A company spokesman stated that the valve sticks and over applies the lotion. When too much lotion is applied it takes longer to dry. And should that product come near an open flame, it can  ignite. One case involved a man standing near a BBQ grill while another involved a woman working with welding equipment.

The aerosol product has become more popular in the last few years because it is faster and easier to apply than traditional sunscreen products. The products were distributed to wholesalers and retailers from January 2010 till September 30, 2012.

Nissan Altima Sedans Recalled for Faulty Bolts

Posted on October 23rd, 2012 No Comments

A recall has been announced, affecting nearly 14,000 vehicles in the Nissan brand.

The Japanese car company told the National Highway Safety Administration that was recalling 2012 and 2013 Altima sedans made this year between May 10th and July 26th. These vehicles produced in a Mississippi Nissan plant were discovered to have certain bolts not tightened to the specified torque levels during the production process.

Four traverse link bolts and two power steering link bolts were found to loosen on their own.  And when this happens, the driver loses the ability to control the direction movement of the car.  When this problem is apparent, drivers might notice a rattling sound. It was discovered at the plant during routine tests of cars coming off the assembly line on July 26th.

Nissan stated there have been accidents and crashes because of this issue but they did not specifiy how many sedans have been ivolved in an accident because of this issue. The motor company plans to ask Altima owners to bring their vehicles back to dealerships in order to correct the torque problem. This will affect 13,919 vehicles.
