An Illinois mother is seeking a class action lawsuit against the makers of Similac baby formula after a recall of millions of containers after there were two reports of baby larvae being found in the formula.
The lawsuit states that Abbott Laboratories, the maker of the the powdered baby formula produced the formula that made her child and many other children sick.
Abbott issued the recall on Sept. 22, but the lawsuit claims that the laboratories knew about the insects and larvae before the recall. The plaintiff is stating that the company did not use “quality control measures” to make sure that the baby formula was safe for consumption.
